Welcome to the Terms of Service (“Terms”) for Holy Cow!, a brand manufactured and operated by by Element Longevity Inc.. (“Element Longevity,” “we,” “us,” or the “Company”).

These Terms govern your use of and access to the sites, content, applications, services, tools and features provided by us (collectively, the “Services”). The Services include, without limitation, the website www.getholycow.com (each individually referred to herein as the “Site,” or collectively as the “Sites”).

By using or accessing the Services, you signify that you have read, understand and agree to be bound by these Terms.

1. WHO MAY USE THE SERVICES

You must be 18 years of age or older and reside in the United States or any of its territories to use our Services. Children under the age of 18 are not permitted to use the Services.

2. INFORMATION DISCLAIMER

Information provided on the Services is for general informational and educational purposes only.

NOT MEDICAL ADVICE: Information on the Sites is not provided as, nor should it substitute for, medical advice.
CONSULT A PROFESSIONAL: If you are seeking medical advice, consult with your physician. If you believe you have a medical emergency, call 911 immediately.
NO DRUG CLAIMS: No information on the Sites is intended to make or imply any drug claims for the treatment of any disease, or to make comparisons against FDA-approved interventions.

3. USER ACCOUNTS

To use certain Services, you may need to create an account (“Account”). You are solely responsible for activity on your Account and for maintaining the security of your password. Notify us immediately at support@getholycow.com if you suspect unauthorized access.

4. REFUND & CANCELLATION POLICY

4.1. 30-Day Return Policy: We want you to be completely satisfied with your purchase. If you change your mind or are unhappy with your product, we accept returns within 30 days of the delivery date.

Method of Return: All returns must be processed by mail. To initiate a return, please contact us at support@getholycow.com for return instructions and our mailing address.
Item Condition: To be eligible for a return, products must be returned in their original, unopened packaging.
Return Shipping Costs: For general returns (buyer's remorse), the customer is responsible for the cost of return shipping. We do not charge any additional restocking fees.
Damaged or Defective Items: If your product arrives damaged or defective, please contact us within 30 days of receipt with photos provided to support@getholycow.com. We will replace the defective item or provide a full refund, and we will cover the return shipping costs for defective items.
Lost Shipments: A shipment is considered lost if not delivered within 14 days of the shipping date (excluding orders marked "delivered" by the carrier).
Ineligible Purchases: Products forwarded outside our shipping area, international orders, and wholesale orders are not eligible for returns or refunds.

4.2. Money Back Guarantee: Valid only for the first time you purchase a Product, redeemable up to 14 days after the end of the Trial Period. Shipping costs are non-refundable.

4.3. Membership Cancellation: Requests must be received by the Sunday prior to the next charge date. If you cancel after an order has shipped, you will not receive a refund for that specific shipment.

5. RIGHTS & RESTRICTIONS

We grant you a personal, non-exclusive right to use the Services. You may not:

Copy, modify, or sell any information obtained through the Services.
Resell Holy Cow! products on third-party platforms (Amazon, Walmart, eBay, etc.) without a specific written agreement from Element Longevity.
Use robots, spiders, or scrapers to "mine" data from the Sites.

6. OWNERSHIP & CONTENT

6.1. Intellectual Property: The "Holy Cow!" and "Element Longevity" names, logos, and "look and feel" of the Site are protected by copyright and trademark laws.
6.2. Feedback: Any suggestions or feedback you provide becomes the sole property of Element Longevity without compensation to you.
6.3. Your Content: If you post a review or testimonial, you grant us a perpetual, royalty-free license to use that content for marketing purposes.

7. PRODUCT DISCLAIMER (PROBIOTICS)

As with any probiotic, minor adverse effects such as gas, change in bowel patterns, bloating, and GI disturbance may occur. These side effects are typical as the microbiome shifts; the body usually acclimates after a few days up to 1 week of use.

8. LIMITATIONS OF LIABILITY

To the maximum extent permitted by law, the Holy Cow!/Element Longevity Entities shall not be liable for any indirect, incidental, or punitive damages. Our total liability shall not exceed one hundred dollars ($100.00) or the amount you paid us in the past six months.

9. ARBITRATION AND CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY.

Informal Resolution: You agree to first contact us at support@getholycow.com to attempt to resolve any dispute in good faith.
Binding Arbitration: If unresolved, disputes will be settled by binding individual arbitration administered by JAMS.
No Class Actions: You waive the right to participate in a class action or class-wide arbitration.

10. SMS MESSAGING

By providing your phone number, you agree that Holy Cow! may contact you via text for customer service or marketing purposes. You may opt out at any time by texting "STOP".

11. ADDITIONAL PROVISIONS

Updating Terms: We may revise these terms at any time. Your continued use of the Site constitutes acceptance of new terms.
Governing Law: These Terms are governed by the laws of the State of California.
Severability: If any part of these Terms is found unenforceable, the rest remains in effect.
